PRIVATE MEMBERSHIP CONTRACT

Gaia Private Club, PMA is a private membership association, where only members of the association have access to, private and group workshops, handmade items, educational events, and guests in all esta tes of Gaia Home Network. This is a safe space to share, express, create and grow mutually. Every member joins the PMA as a real, breathing, flesh and blood, living sovereign man or woman utilizing their aboriginal birthright’s ability; and inalienable right, to privately contract. Members join in their Propria Persona, Sui Juris, In Proprio Solo, In Proprio Heredes (Own Person, Own Rights, Own Land, Own Heir) as natural private person and in their highest character, with capacity and standing, fully equal to all other sovereign men or women members.

This agreement (meeting of the minds) creates a bond between you, and us, Gaia Private Club, PMA protecting us equally.

CONTRACT SUMMARY

Gaia Private Club is a PRIVATE MEMBERSHIP ASSOCIATION under private domain non statutory, protected by the 1st, 5th 9th AND 14th Amendment to the United States Constitution. Members join with the purpose of obtaining access to a community that offers ancestral education, holistic alternatives, spiritual retreat accommodation, local grown food, including, but not limited, to raw fruits, vegetables, fungi’s, seeds, nuts, and legumes directly from the farm hands. Obtaining access to surreal art, handmade inventions, cruelty free and healthy recipes, herbal tonics, infusions, decoctions, and formulations. To protect all members of the PMA from any adverse action by any local, municipal, city, county, commonwealth, state or national administrative or regulatory agency, BAR Association or member, or court in exchange for the benefits offered by the PMA, all members agree and consent to the terms and conditions set forth in this contract. Each member takes upon themselves the responsibility for the safety, security and privacy of their private person that chooses to consume, accommodate to retreat and possibly apply educational information in the quest of living Free and exercising Liberty.

BACKGROUND

The Supreme Court has acknowledged that certain implicit rights, such as association, privacy, and presumed innocence, share constitutional protection in common with explicit guarantees such as free speech. Specifically, the Supreme Court has described the right to associate as inseparable from the right to free speech. Members of Gaia Private Club, Private Membership Association (PMA) private contract is under the due process liberty clause of the 5th and 14th Amendments, and the state/territory may not pass laws that impair the obligation of a contract. Under the 1st and 14th Amendment of the U.S. Constitution and equivalent provisions of the State/Territory Constitution, you have the right to associate with fellow members and offer benefits and services that are outside of the jurisdiction, venue and authority of Local, State and/or Federal agencies. Members of Gaia Private Club, PMA does not fall under the jurisdiction of local, state, and federal governments and corresponding laws and regulations.

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

In consideration of receiving services, food, herbal solutions, holistic alternatives and or permission to guest in any of the estates Gaia Private Club provides services, I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Gaia Private Club Owner, Trustees, Members, Partners, Collaborators (hereinafter referred to as “RELEASES”) from any and all liability, claim, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASES, or otherwise, while participating in such activities or service, or while in, on or upon the premises where the activity or service is being conducted. To the best of knowledge, I am in good physical condition and am not aware of any physical infirmity which would place me at risk in using such equipment. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISK OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES or otherwise. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any loss, liability, damage or cost, including court costs and attorney’s fees, that they may incur due to my participation in said activity and service, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES or otherwise. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASES, I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State in action. In signing this release, I acknowledge and represent that I have read and understood it and signed it voluntarily; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same. I HAVE READ THIS WAIVER OF LIABILITY AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

MISSION

MISIÓN

Gaia Private Club, PMA strives for greater availability of local cruelty free products and services by providing education to its members. Our association understands that health and wellness has many dimensions and strives everyday to provide quality food products, complementary and alternative therapies including the rights of Spiritual beliefs, not indoctrinated religious ones. Gaia Private Club, PMA also provides its members with workshops, special events, tours, consultations, cooking classes, health coaching, and other training toward the advancement of holistic trinity (mind, body, spirit) wellness. A symbiotic relationship exists between the services, the products and accommodations that are offered by the Association.

MEMORANDUM OF UNDERSTANDING

I understand that members of the Association that provide services or advice do so in the capacity of collaborators and are member facilitators in a private manner and not in the capacity as public healthcare facilitators. I understand that within the Association no Public Doctor Patient or Public Therapy Client relationship exists. Within the Association I freely choose to change my legal status from that of a Public Health Care Recipient, to that of a Private Membership Association recipient. I realize that in doing so I relinquish certain Federal, State and local protections and privileges. I understand that it is my personal responsibility to evaluate the services offered and to educate myself as to efficacy, risks, or desirability. I agree that the actions I take, in this regard, are my own free will decisions. If I am accepted for membership, I will exercise my rights for my own benefit and agree to hold harmless the Association and member facilitators from any unintentional liability that might result from the advice or services I receive, except for the harm that could remotely result from an instance of “a clear and present danger of substantive evil” as determined by the Association and as defined by the United States Supreme Court. I understand and accept that, since the Association is protected by the First, Ninth and Fourteenth Amendments to the United States Constitution, it is exempt from any action of Federal, State and local agencies entrusted to “protect the public” as it relates to any complaints or grievances against the Association, its physical premises or equipment its Trustees, member facilitators or other associated staff or consultants. All complaints or grievances will be settled by non judicial mediation, within the Association. Also, those membership and private member records kept by the Association are strictly protected and can only be released upon written request of the subject member. I agree that I am joining this Private Membership Association, unincorporated under the common law with articles of association and Bylaws (Read Terms and Conditions at www.gaiaprivateclub.com/ArticlesofAssociation). I understand that members seek to help each other achieve and sustain better health. I accept that the facilitators, and other health care providers, who are fellow members, offer advice, services, and benefits that are not necessarily conventional or traditional. As a Member, my goal is to accept those health and wellness services that I feel will truly help me. I will choose procedures that I consider proper and have a reasonable chance of making my health and life better. I realize that no health screening, resulting conclusions or health care services are my activities within the Association are a private matter and I refuse to share them with any Federal, State or local regulatory enforcement agency, medical board, FDA, Medicare or Medicaid. The health and/ or sickness records that I have shared with other members remain the property of the Association. I, in becoming a member, agree not to file malpractice, civil or criminal lawsuits against a fellow member, unless that member exposes me to a clear and present danger of substantive evil. I further agree that all association members are exempt from the provisions of any state Medical Practices Act, Federal Food Safety Modernization Acts, Codex Alimentarius or any similar federal or state legislation. I enter into this agreement of my own free will, or on behalf of a designated dependent, without any pressure or promise of benefit. I affirm that I do not represent any state or federal agency whose purpose is to regulate the practice of medicine or any other health care system. I accept that membership does not entitle me to any voting interest in the Association. I have read and understand this contract and any questions I had were answered fully to my satisfaction.

MEMORANDO DE ENTENDIMIENTO

Non-Medical Practices

I agree and understand that Gaia Private Club, PMA is not medically licensed, and is not practicing medicine, and that I should always consult my personal doctor before consuming anything or doing modifications to my diet. I agree to hold Gaia Private Club, PMA (all members) free of responsibility from any medical complications that I may suffer while in contact with their items. All items consumed are consumed with my own consent and discernment.

I understand that the Association is protected by the First and Fourteenth Amendments to the U.S. Constitution, it is outside the jurisdiction and authority of Federal and State Agencies and Authorities concerning any and all complaints or grievances against the Association, any Trustee(s), members or other staff persons. All rights of complaints and grievances will be waived by the member for the benefit of the Association and its members. I fully understand that I am consuming “raw” food products. The member waives HIPAA privacy rights and complaint processes.

Donations

Donaciones

I agree and understand that donations are voluntary, however, as a member they are required to cover expenses and administration fees for the members and are non-refundable. As a Gaia Private Club, PMA member, I understand that the PMA has a Member Cost Sharing Policy, and that if I am to receive products from the PMA’s livestock, then I am obligated to remit to the PMA at the time of receipt my Cost Share for such product. I also understand that the Trustees may from time to time assess a transaction fee or an annual or periodic membership fee; additional assessments may be made at any time for services or benefits rendered. I agree and accept that all items offered within the PMA are hand-made and created with the purest intentions. I agree that it being hand-made, foreign substances may be found from time to time, which is highly unlikely, but I still accept this uncertainty if it were ever to occur. I also agree that these hand-made items are not to be construed as medical treatments, medicines, or illness/disease healing items. Furthermore, I agree that I shall not share these items labeled, but not limited to, “for members only”, “member only”, “Private item”, with other non-members of the PMA,

I agree that the donations are not to be construed as commerce, and there is no promise to receive an exact return, whether an item or service, nor are they subject to commercial laws. Any unauthorized use or variations created by members thereof without the founders express, prior, written permission signifies the user’s consent for becoming the debtor on a self-executing UCC financial statement in the amount of $750,000 american constitutional money payable in gold or silver per unauthorized use of the intellectual property use.

El diseño, concepto, servicio, logística, calendarios, programas, educación, estructura de la organización y decoración, pinturas, arte, logos, finanzas, contratos, material de mercadeo, productos y servicios están protegidos por el derecho de autor. Termination of Membership

Indefinite Term. This Agreement shall become effective on the Effective Date and shall, unless otherwise terminated in accordance with the provisions hereof, continue in effect for an indefinite term of years.

In order to end your membership, you must send a color scanned wet inked signed document, stating your intentions of leaving the membership via email to gaiaprivateclub@gmail.com, the trustee of the PMA will accept your document, and inform you that your membership has been ended.

External PMA’s

I understand that if I belong to another PMA, I may still join Gaia Private Club PMA, as long as I abide by everything in this agreement. I also make sure that any other PMA that I may be part of, allows me to join other PMA’s, and I hold Gaia Private Club PMA free of responsibility if I suffer any penalties from other PMA regulations.

Your activities within the Association are private, non statutory and not to be shared with government agencies of federal, state and local jurisdiction. You are not a State or Federal agent whose purpose is to regulate.
